Can the broker withhold payment to the carrier after the vehicle has been delivered?

A couple of vehicles has been damaged during transport. The broker is refusing to send payments unless they see proof that the insurance claim is going through. If it is wrong of them to withhold payment, is there some documentation from the DOT or FMCSA to prove that they are wrong. And what actions can I take to make them pay?
